Terms of sale

These terms apply to everything you buy on alientechtools.co.uk. Please read them before you order. If anything is unclear, ask us first: 0115 678 0707 or sales@mmtperformance.co.uk.

1. Who we are

This shop is run by MMT Performance, Unit 1, 659-663 Nuthall Road, Nottingham, NG8 6AF, an authorised Alientech dealer (“MMT”, “we”, “us”).

2. Your order

When you place an order you are offering to buy the products in it. A contract is made when we confirm the order to you by email or phone and take payment. If we cannot supply something (for example because Alientech has changed a product), we tell you and take no payment for it.

While the shop shows the option “Order now, MMT calls you to take payment”, nothing is charged online: we call you in opening hours to confirm the order, delivery and payment before anything is sent.

3. Prices

Prices are in pounds sterling and are the prices shown when you order. Delivery is charged as shown at checkout, or as we confirm with you before you pay. If a price on the site is obviously wrong, we tell you before accepting the order.

4. Tools, licences and subscriptions

KESS3 protocols and subscriptions are Alientech licences. They are activated on the serial number of your tool and registered with Alientech in your name, and Alientech’s own terms apply to its software and updates. A subscription period starts when the licence is activated.

A slave tool is linked to MMT as its master. Files you send through the MMT portal are handled under the portal’s own terms.

5. Delivery

See our delivery page. The products are yours once they have been delivered or collected and paid for in full.

6. Cancelling if you are a consumer

If you buy as a consumer (not for your business), you can cancel within 14 days of the day you receive the goods, without giving a reason. Tell us by phone or email. Return the goods within 14 days of telling us, at your cost, unused and with everything they came with; we refund the price and the standard delivery cost within 14 days of receiving them back. If the goods have been handled more than you would in a shop, we may reduce the refund by the loss in value.

Protocols and subscriptions are digital licences. If you ask us to activate them before the 14 days end, we will only do so with your express consent and your acknowledgement that you lose the right to cancel the licence once activation starts.

7. Business customers

If you buy for your business there is no right to cancel. Returns of unused goods are by agreement with us.

8. If something is faulty

If you are a consumer you have legal rights under the Consumer Rights Act 2015 when goods are faulty or not as described, and nothing in these terms affects them. For every customer, we deal with Alientech on your behalf as your dealer under the manufacturer’s warranty. Contact us first, before sending anything back.

9. Lawful use

Tools are sold for lawful use. Modifying or removing emissions equipment on a vehicle used on public roads is illegal in the UK. Where the law allows us to, we exclude liability for losses caused by using a tool against the manufacturer’s instructions or the law. Nothing here limits liability for death or personal injury caused by negligence, or for fraud.

10. Law

These terms are governed by the law of England and Wales. If you are a consumer living elsewhere in the UK, you can also bring proceedings where you live.
